Terms of Service

1. Acceptance of Terms

By creating an account or using Brainrot Factory (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. The Service

Brainrot Factory generates short-form vertical videos from sources such as Reddit posts, article URLs, custom scripts, and AI topics, using text-to-speech narration, captions, and background footage. It also offers scheduled “autopilot” series and one-click publishing to connected YouTube channels.

3. Eligibility and Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for the accuracy of your account information and for maintaining the security of your account.

4. Plans, Billing, and Cancellation

The Service offers a free tier and paid subscriptions (Pro and Studio), billed on a recurring basis through Stripe. Paid subscriptions renew automatically until cancelled.

You may cancel at any time; your plan remains active until the end of the current billing period, and we do not provide refunds for partial periods except where required by law. We may change pricing with reasonable advance notice.

5. Acceptable Use

You agree not to use the Service to:

• Create or distribute content that is illegal, infringing, defamatory, hateful, or harassing.
• Violate the terms or policies of any platform you publish to, including YouTube.
• Generate spam or engage in deceptive, abusive, or large-scale low-quality publishing.
• Reverse engineer, disrupt, overload, or attempt to gain unauthorized access to the Service or its infrastructure.

6. Your Content and License

You retain ownership of the scripts, prompts, and footage you provide. You grant us a limited license to host, process, and transform that content solely to operate the Service and produce your videos.

You represent that you have the rights necessary to use any source material you submit, and you are responsible for the content you generate and publish.

7. Generated Output

Subject to these Terms and the terms of any third-party providers (such as stock footage and voice providers), you own the videos you generate. You are responsible for ensuring your use and publication of generated output complies with applicable laws and platform policies.

8. Third-Party Services and Platforms

The Service integrates with third parties such as Google/YouTube, Stripe, and ElevenLabs. Your use of those services is subject to their respective terms. We are not responsible for the availability or actions of third-party platforms, including any moderation, strikes, or removals applied to your channel.

9. Intellectual Property

The Service, including its software, design, brand, and the curated background library, is owned by Eskay Tech Pte. Ltd. and protected by intellectual property laws. These Terms do not grant you any rights in our intellectual property except as needed to use the Service.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind. AI-generated output may contain errors or inaccuracies, and we do not warrant that the Service will be uninterrupted or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, Eskay Tech Pte. Ltd. will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Eskay Tech Pte. Ltd. from any claims, damages, or expenses arising out of your content, your use of the Service, or your violation of these Terms.

13. Termination

We may suspend or terminate your access if you breach these Terms or use the Service in a way that harms us, other users, or third parties. You may stop using the Service at any time.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the date at the top of this page, and your continued use of the Service constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of Singapore, without regard to conflict-of-laws principles. The courts of Singapore will have exclusive jurisdiction over any disputes arising from these Terms or the Service.
